Not all regulatory news is bullish. The crypto industry's biggest legislative bet, the market structure bill known as the CLARITY Act, appears to be running out of runway. The bill would establish a formal framework for digital assets, divide oversight between the SEC and the CFTC, set registration requirements, and strengthen anti-money-laundering protections. Despite backing from President Trump and heavy industry lobbying, many participants now believe the bill is effectively dead for 2026.

CNBC reports that after years of operating under a hostile regulatory regime, the industry may have simply learned to keep moving without a definitive framework from Washington. Sticking points include an ethics clause restricting elected officials from launching tokens, unresolved DeFi treatment rules, and disagreements over stablecoin yield. A failed vote would leave SEC and CFTC guidance letters as the primary rulebook, a softer foundation than federal statute that analysts warn could be reversed by any future administration.
